Crown-witness provisions create numerous problems and tensions on different levels of the Swiss legal system, which are not only multilayered but also interconnected and of varying importance. In contrast to the United States or Germany, for instance, relatively few essays on this subject have been published in Switzerland.¹ However, the findings from other countries must not be transferred to Switzerland without further analysis because the framework conditions and needs for use are often fundamentally different. But even in Switzerland, the central dialectical tension between security and rule-of-law considerations can be resolved.
